Section 138 mandates strict timelines:

  • The cheque must be presented within 3 months from the date of issue.

  • Legal notice must be sent within 30 days of cheque dishonour.

  • The complaint must be filed within 30 days from expiry of the 15-day notice period. Failure to comply with any timeline may lead to dismissal. However, courts may condone delay under Section 142(b) if sufficient cause is shown.
