A criminal trial is a structured legal process that determines whether an accused is guilty of the offence. In India, trials are governed by the Code of Criminal Procedure (CrPC), and each stage has its own legal relevance.
Let’s explore the key stages in a typical criminal trial:
1. Registration of FIR
The process begins with the registration of an FIR, generally at a police station. This FIR contains the details of the alleged criminal act.
2. Investigation
The police investigate by collecting evidence, examining witnesses, and preparing a final report. Depending on the findings, they may file a charge sheet (if evidence supports the offence) or a closure report (if evidence is insufficient).
3. Cognizance by Magistrate
The court takes cognizance of the offence and decides whether to proceed with the trial. This step is vital to ensure that the charge sheet is not mechanically accepted.
4. Framing of Charges
If a prima facie case exists, charges are framed against the accused. The accused is formally informed about the charges and is given the right to contest them through legal representation.
5. Trial
The trial includes examination of prosecution witnesses, cross-examination by the defense, and then defense witnesses, if any. This stage tests the truth of the accusations.
6. Arguments and Judgment
After evidence and witness testimony, both sides present their final arguments. The judge then delivers the verdict—either conviction or acquittal.
7. Appeal and Revision
If any party is dissatisfied with the judgment, they may file an appeal in a higher court. The appellate process may review legal or factual errors in the trial.
