Disability Percentage Is Not Always the Real Loss: MACT Compensation Must Reflect Loss of Earning Capacity

A victim with a low percentage of physical disability may still receive higher compensation if the disability destroys or substantially affects his earning capacity. The Supreme Court has reaffirmed that compensation under the Motor Vehicles Act must be fair, just and based on the actual impact on livelihood.
