Judicial Separation vs Divorce: Understanding the Legal Distinction
Marriage breakdowns don't always lead directly to divorce. In India, judicial separation provides a legal alternative to couples who want to live apart without formally ending the marriage.
What is Judicial Separation?
Under Section 10 of the Hindu Marriage Act, 1955, judicial separation allows spouses to live separately without dissolving the marriage. It's often a precursor to divorce and gives couples time to reconcile.
What is Divorce?
Divorce is the legal dissolution of marriage under Section 13 of the Hindu Marriage Act. Once granted, the marital relationship ends permanently, allowing both parties to remarry.
