Can an Advocate Sign a Compromise on Behalf of a Client? Supreme Court Clarifies Order XXIII Rule 3 CPC

The Supreme Court has held that after the 1976 amendment to Order XXIII Rule 3 of the Code of Civil Procedure, a compromise decree cannot be passed merely because an advocate has signed the compromise petition. Unless the advocate has express authority from the client or the compromise bears the signature of the parties, such a compromise may be declared invalid.
